1. About Welluma
Welluma is a personal health companion application developed and operated by Welluma Health Inc., a company incorporated in Ontario, Canada. Welluma is designed to help patients record, understand, and manage information from their medical appointments.
2. Medical Disclaimer
IMPORTANT: Welluma is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment.
Specifically:
- Welluma is a personal information management tool only
- AI-generated summaries are for personal reference only and may contain errors or omissions
- All summaries should be reviewed for accuracy — speech recognition may misinterpret medical terms, medication names, or proper nouns
- Always consult your qualified healthcare provider for medical decisions
- Do not delay seeking medical attention based on information provided by Welluma
- Linked health resources are provided for informational purposes only and are not affiliated with Welluma
3. Recording Consent and Legal Compliance
3.1 Your Responsibility
Recording laws vary significantly by province, state, and country. It is YOUR sole responsibility to ensure that you have obtained all required legal consents before recording any medical appointment or conversation using Welluma.
3.2 Required Consents
By using the recording feature, you confirm that:
- Your healthcare provider is aware of and has consented to the recording of your appointment
- You have obtained any required consent under applicable laws in your jurisdiction
- The recording is for your personal health management only
- You will not use recordings for any unauthorized or unlawful purpose
3.3 Limitation of Liability for Recording
Welluma Health Inc. is not responsible for any legal issues, penalties, claims, or damages arising from unauthorized recording of healthcare providers, staff, or any other individuals. You assume full legal responsibility for all recordings made using Welluma.
4. User Accounts
- You must be at least 18 years of age to create an account
- You are responsible for maintaining the security and confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorized use of your account
- You may not share your account with others
5. Sharing of Visit Summaries
5.1 Your Responsibility When Sharing
Welluma allows you to share visit summaries with trusted contacts such as family members or caregivers. By sharing a visit summary, you acknowledge that:
- You are sharing personal health information at your sole discretion and risk
- The summary may contain inaccuracies due to speech recognition limitations
- Recipients should be made aware that the summary is AI-generated and is not a substitute for professional medical advice
- Welluma Health Inc. is not responsible for any consequences arising from sharing visit summaries with third parties
5.2 Sharing Disclaimer
All shared summaries include a Welluma disclaimer stating that the content is AI-generated, may contain errors, and is not a substitute for professional medical advice.
6. Subscriptions and Payments
- Welluma requires a subscription to access all features at $4.99 CAD/month
- Subscriptions are managed through Apple App Store (iOS devices) or Google Play (Android devices) and are subject to the respective platform's payment terms
- Subscription billing and entitlement verification is also managed by RevenueCat Inc. on our behalf
- Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
- No refunds are provided for partial subscription periods
- To cancel on iOS: Open the App Store → your Apple ID → Subscriptions → Welluma → Cancel
- To cancel on Android: Open Google Play → Profile → Payments & subscriptions → Subscriptions → Welluma → Cancel
- You may restore a previous purchase at any time using the "Restore Purchases" option within the app
7. Privacy and Data Protection
Your use of Welluma is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Welluma, you consent to our collection and use of your data as described in our Privacy Policy.
Welluma Health Inc. complies with applicable Canadian privacy laws including PIPEDA and Ontario's PHIPA to the extent applicable.
8. Third-Party Services
Welluma uses the following third-party services to operate the application:
- Anthropic Claude AI: Processes visit transcripts solely to generate plain-language summaries. Transcripts are not retained by Anthropic after processing. Subject to Anthropic's Terms of Service and Privacy Policy.
- Supabase: Provides secure account management and data storage on SOC 2 Type II certified servers located in Canada (ca-central-1). Subject to Supabase's Terms of Service.
- RevenueCat Inc.: Manages in-app subscription status, purchase verification, and billing history for both iOS and Android. RevenueCat receives your app user ID and subscription transaction data. Subject to RevenueCat's Terms of Service and Privacy Policy.
- Apple Inc. (App Store): Processes in-app purchases for iOS users. Subject to Apple's Media Services Terms and Conditions.
- Google LLC (Google Play): Processes in-app purchases for Android users. Subject to Google Play's Terms of Service.
- External Health Resources: Links to Mayo Clinic, NIH, CDC, CAMH, CHEO, CPS, UHN, Drugs.com, Medscape, and other reputable sources are provided for informational purposes only. Welluma is not affiliated with these organizations.
9. Limitation of Liability
To the maximum extent permitted by law, Welluma Health Inc. shall not be liable for:
- Any medical decisions made based on Welluma summaries or linked resources
- Inaccuracies in AI-generated summaries due to speech recognition errors
- Legal consequences arising from unauthorized recording
- Loss or unauthorized access to health data
- Any indirect, incidental, special, or consequential damages
- Service interruptions or technical failures
10. Indemnification
You agree to indemnify and hold harmless Welluma Health Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of Welluma, violation of these Terms, unauthorized recording, or infringement of any third-party rights.
11. Acceptable Use
You agree NOT to use Welluma to:
- Record any person without their knowledge or consent where required by law
- Record for any commercial purpose without written permission
- Share health information of others without their explicit consent
- Attempt to misuse, reverse engineer, or circumvent the application
- Use the service for any unlawful purpose
12. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the app Settings screen. Upon termination, your data will be handled in accordance with our Privacy Policy.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by email or through the app. Continued use of Welluma after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario, Canada.
